Why is an Indian nurse being executed in Yemen?
And why are efforts being made to stop this execution?
Nimisha Priya, a nurse from the Indian city of Kerala, was sentenced to death in 2020 after being convicted in 2018 in Yemen for the murder of her business partner, Talal Abdo Mahdi. The court imposed the charge that she gave Mahdi a sedative, which caused his death, and later his body was dismembered and thrown into a water tank.
Legal and Religious Context:
Under Yemeni law and Sharia, the heirs of the deceased have the right to “Qisas” (retributive justice) instead of the court’s punishment. They can either demand the death penalty or request pardon through “Diyah” in exchange for the death sentence.
What is happening?
The family of the deceased has made it clear that they will not accept a pardon under any circumstances and are demanding that the Qisas punishment be implemented immediately.
The date of the death penalty was initially set for July 15, 2025, but due to religious and diplomatic intervention, it has been temporarily postponed.
Diplomatic and Religious Support:
The Indian government is taking all possible measures: legal aid, consular access, and mediation are being explored for the possibility of a pardon.
Intervention of religious leaders: India’s Grand Mufti Kanthapuram A.P. Aboobacker Musliyar contacted Yemeni scholar Sheikh Habib Umar bin Hafiz to persuade Mahdi’s family to accept the offer of Diyah.
International assistance: Iran has also offered intervention on humanitarian grounds, with the hope that its relations with Yemen could bring leniency to the matter.
Court and Judicial Response:
The Supreme Court of India has accepted a plea for intervention in the matter, and the hearing is ongoing. The court has clearly stated that any non-official intervention could hinder diplomatic efforts.
National Coordination: The Ministry of External Affairs has stated that the matter is “sensitive” and is being given full attention.
